Terms of Service

These Terms of Service govern your use of the Inclusive Learning Library, operated by The Inclusive Practice, LLC. By creating an account or using the platform, you agree to these terms.

1. The Service

The Inclusive Learning Library is a curriculum integration platform for K–12 educators. It provides access to frameworks, resources, and tools designed to support inclusive literacy instruction. Features vary by subscription tier.

2. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Notify us immediately at eric@theinclusivepractice.com if you suspect unauthorized access. You may not share your account with others or create accounts on behalf of others without authorization.

3. Subscriptions and Payment

Paid subscriptions are billed in advance on a recurring basis. Prices are stated at the time of purchase. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods. Stripe processes all payments — we do not store your payment card information.

4. Content and Intellectual Property

All content in the Inclusive Learning Library — including frameworks, resources, activities, and materials — is owned by or licensed to The Inclusive Practice, LLC. Your subscription grants you a limited, non-transferable license to access and use content for your own educational practice within your school or district. You may not reproduce, redistribute, resell, or publish library content without written permission.

5. User-Submitted Content

If you submit content (notes, adaptations, resources) to the platform, you retain ownership and grant The Inclusive Practice, LLC a limited license to display it within the platform. You represent that you have the right to submit any content you provide.

6. Acceptable Use

You agree not to: use the platform for any unlawful purpose; attempt to gain unauthorized access to any part of the platform; scrape, copy, or redistribute platform content in bulk; impersonate another person or organization; or interfere with platform operation.

7. Student Privacy

If you use the platform in connection with students, you are responsible for compliance with applicable student privacy laws including FERPA. Do not enter personally identifiable student information beyond what is necessary for the service. See our Privacy Policy for how student-related data is handled.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE IS AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE INCLUSIVE PRACTICE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your account for violation of these terms. You may delete your account at any time. Upon termination, your right to access the platform ceases and your data will be handled per our Privacy Policy.

11. Changes to Terms

We will notify you of material changes by email at least 14 days before they take effect. Continued use after that date constitutes acceptance.

12. Governing Law

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Massachusetts.
